The legal selling entity for a purchase will be identified in the applicable quotation, pro forma invoice, order confirmation or sales agreement.
By using the Website, you agree to these Terms. If you do not agree, please do not use the Website. These Terms apply to Website use and online inquiries. Any quotation, pro forma invoice, order confirmation, sales agreement or other transaction document accepted by both parties may contain additional terms that govern a specific purchase.
1. Business Use and Eligibility
The Website is intended primarily for businesses and professionals sourcing metal packaging, samples, customization or related manufacturing services. You represent that you have the legal capacity and, when acting for a company or other organization, the authority to act on its behalf.
Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable law.
2. Website Information
We aim to keep product descriptions, dimensions, capacities, materials, finishes, images and other Website content accurate and useful. However, such content is provided for general information and initial sourcing only.
Website content does not constitute a binding offer, product warranty, certification or guarantee that a product is suitable for a particular formulation, filling process, market or regulatory requirement. Colors, finishes and apparent proportions may vary by screen, photography, material, production process and manufacturing tolerance. Buyers should confirm final specifications, compatibility, testing and compliance requirements before ordering.
We may correct errors and update, replace or discontinue Website content or products without prior notice.
3. Quote and Sample Requests
Submitting an inquiry, quote request, sample request or file does not create a purchase contract and does not require DOLYPACK to accept a project. A binding transaction is formed only through the applicable quotation, pro forma invoice, order confirmation, sales agreement or other written acceptance used for that order.
Pricing, minimum order quantity, tooling, sampling, decoration, payment, taxes, production lead time, delivery, title, risk of loss, inspection, claims, returns and warranty terms are project-specific. The terms stated in the applicable transaction document control if they conflict with general Website information or these Terms.
Unless a transaction document states otherwise, quotations and delivery estimates may change when specifications, artwork, quantities, material costs, exchange rates, shipping conditions or other project requirements change.
4. Custom Products, Artwork and Approvals
If you submit specifications, artwork, logos, trademarks, drawings, packaging copy or other project materials, you represent that:
- the information is accurate and sufficiently complete for evaluation;
- you own the materials or have permission to use and provide them;
- our authorized use of them for your project will not infringe another party's rights; and
- you will identify any technical, safety, compatibility, labeling or regulatory requirements that apply to your product or market.
You grant DOLYPACK a limited, non-exclusive right to use submitted materials only as reasonably necessary to evaluate, quote, sample, manufacture and support your requested project.
You are responsible for reviewing and approving samples, drawings, proofs, colors, dimensions, construction, labeling and other agreed specifications before mass production. Changes requested after approval may affect price and schedule. Ownership, storage, maintenance and future use of molds, dies, printing plates or other tooling will be determined by the applicable quotation or order document.
5. Acceptable Use
You may not use the Website to:
- violate any law or another party's rights;
- submit unlawful, deceptive, infringing, malicious or harmful content;
- introduce malware or attempt to bypass Website security;
- scrape, copy or harvest Website content or data through unauthorized automated means;
- interfere with the Website, servers or other users;
- impersonate another person or misrepresent your identity or authority; or
- use Website content to create a misleading association with or endorsement by DOLYPACK.
We may restrict or block access when we reasonably believe use of the Website is unlawful, harmful or inconsistent with these Terms.
